1. Scope
These General Terms and Conditions apply to purchases made through the AQSA ATELIER online shop by consumers and, unless otherwise agreed, business customers.
A consumer is any natural person acting for purposes predominantly outside their trade, business or profession.
2. Seller
The seller and contractual partner is:
AQSA ATELIER
Email: aqsaatelierco@gmail.com
Temporary legal notice and address reference: https://aqsaatelierco.etsy.com
Website: https://www.aqsaatelier.com
Before the shop accepts orders, this temporary reference must be replaced with or linked to a complete legal notice containing the owner’s full legal name, valid business address and any legally required business information.
3. Products
The essential characteristics of each product are stated on its product page.
Product photographs are intended to represent the items as accurately as possible. Minor differences in colour may result from lighting, photography or screen settings. Small variations may occur in handmade or individually finished items, provided that they do not materially alter the agreed characteristics of the product.
Jewellery-care information forms part of the relevant product description where provided. Normal wear, scratches, tarnishing or damage caused by improper use, chemicals, moisture or incorrect storage do not constitute defects unless the product was already defective when supplied.
4. Formation of the Contract
The products displayed in the shop constitute an invitation to place an order and are not themselves a binding offer.
By clicking the final button labelled “Order with obligation to pay”, or an equivalent clear wording, the customer submits a binding offer to purchase the products in the shopping cart.
An automatically generated acknowledgement only confirms that the order has been received. Unless the acknowledgement expressly accepts the order, the contract is concluded when AQSA ATELIER sends an order acceptance or shipping confirmation.
AQSA ATELIER may decline an order for legitimate reasons, including incorrect pricing, suspected fraud, payment failure or unavailability. Any payment already received for a declined order will be refunded promptly.
The customer must provide complete and accurate order, billing and delivery information.
5. Prices and Payment
The prices displayed at the time of ordering apply. Any applicable taxes and mandatory charges are displayed in accordance with the tax treatment applicable to AQSA ATELIER.
Shipping costs and any other additional charges are shown before the customer submits the order.
Available payment methods are displayed during checkout. Payment is due according to the conditions of the selected payment method. Payment services may be subject to the payment provider’s own terms and privacy information.
For deliveries outside the European Union, import taxes, customs duties or local charges may be imposed by the destination country. Unless expressly stated otherwise, these charges are not included in the purchase price and must be paid by the customer.
6. Delivery
Available delivery countries, estimated delivery times and shipping costs are displayed in the shop or during checkout.
Delivery times are estimates unless a binding date has expressly been agreed. AQSA ATELIER is not responsible for delays caused by incorrect customer information or circumstances outside its reasonable control. Mandatory consumer rights remain unaffected.
For consumer purchases, the risk of accidental loss or damage generally passes to the customer when the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods.
If a product becomes unavailable after an order has been accepted, the customer will be informed and any payment for the unavailable product will be refunded.
7. Retention of Title
Products remain the property of AQSA ATELIER until the purchase price has been paid in full.
8. Right of Withdrawal
Consumers generally have the right to withdraw from an online purchase within 14 days without giving a reason.
For goods, the withdrawal period begins on the day on which the consumer, or a third party designated by the consumer other than the carrier, takes possession of the goods. Where an order is delivered in separate shipments, the period begins upon receipt of the final item.
To exercise the right of withdrawal, the consumer must send an unequivocal statement before the withdrawal period expires to:
AQSA ATELIER
Email: aqsaatelierco@gmail.com
Temporary address reference: https://aqsaatelierco.etsy.com
The consumer may use the model withdrawal form below, but its use is not mandatory.
9. Effects of Withdrawal
Following a valid withdrawal, AQSA ATELIER will refund the payments received for the returned goods, including the cost of the least expensive standard delivery offered for the original order.
Any additional delivery cost resulting from the customer choosing a more expensive delivery method is not refundable.
The refund will be made without undue delay and no later than 14 days after AQSA ATELIER receives the withdrawal notice. AQSA ATELIER may withhold the refund until the returned goods have been received or the customer supplies evidence of having returned them, whichever occurs first.
The refund will normally be made using the original payment method unless expressly agreed otherwise.
The customer must return the goods within 14 days of notifying AQSA ATELIER of the withdrawal. The customer bears the direct return-shipping costs, except where the goods are defective or AQSA ATELIER has agreed to cover those costs.
The customer is liable only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
10. Exceptions to Withdrawal
The statutory right of withdrawal may not apply to:
- Goods made to the customer’s specifications
- Clearly personalised or engraved products
- Sealed goods that are unsuitable for return for genuine health-protection or hygiene reasons, where the seal has been removed after delivery
A product is not excluded from withdrawal merely because it is jewellery. Any applicable exception will be clearly disclosed before purchase.
11. Defective or Incorrect Products
Mandatory statutory conformity and warranty rights apply.
If an item is defective, damaged upon delivery, materially different from its description or incorrect, the customer should contact aqsaatelierco@gmail.com and provide the order number and, where useful, photographs of the issue.
The customer is not responsible for reasonable return costs relating to a confirmed defective or incorrectly supplied item. Depending on the applicable statutory requirements, the customer may be entitled to repair, replacement, a price reduction or termination of the contract.
These rights are separate from the voluntary right of withdrawal and cannot be excluded by these Terms.
12. Voluntary Guarantees
No additional commercial guarantee is provided unless one is expressly stated on the relevant product page. Any voluntary guarantee does not restrict statutory consumer rights.
13. Liability
AQSA ATELIER is liable in accordance with mandatory law.
Nothing in these Terms excludes or limits liability for intentional misconduct, gross negligence, personal injury, product liability, fraudulent concealment of a defect or any other liability that cannot legally be excluded.
For slight negligence, liability may be limited to reasonably foreseeable damage resulting from a breach of an essential contractual obligation, insofar as such a limitation is permitted by applicable consumer law.
14. Intellectual Property
All photographs, texts, designs, branding and other website content are protected by applicable intellectual-property law. They may not be reproduced, distributed or used commercially without prior permission from AQSA ATELIER.
Purchasing a product does not transfer any intellectual-property rights in its design, photographs or presentation.
15. Complaints and Dispute Resolution
Questions and complaints may be sent to:
aqsaatelierco@gmail.com
AQSA ATELIER is not obliged or willing to participate in proceedings before a consumer arbitration body unless participation is required by law or expressly agreed in an individual case.
The former European Commission Online Dispute Resolution platform was discontinued on 20 July 2025 and is therefore not linked in these Terms.
16. Governing Law
These Terms and the contracts concluded under them are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law does not deprive them of mandatory protections granted by the law of the country in which they habitually reside.
Mandatory statutory rules concerning jurisdiction remain unaffected.
17. Severability
If an individual provision of these Terms is invalid or unenforceable, the remaining provisions remain unaffected. The invalid provision will be replaced by the applicable statutory rule. This does not restrict mandatory consumer rights.
